Terms of Service
Welcome to FloorballToday. You can find us at Boterdiep 69-1, 9712 LK in Groningen, the Netherlands. FloorballToday is a digital journalistic sports medium, focused on floorball. We’re registered at the Dutch Chamber of Commerce under number 74701894. These general terms of service apply to all services that FloorballToday offers and to all agreements between FloorballToday and you. FloorballToday reserves the right to change these terms of service at any time. By using the digital services of FloorballToday you agree to the terms and conditions.
Service
FloorballToday offers quality sports journalism, like reports and interviews, via its website (www.floorballtoday.com – from now on called the Website) and other digital and non-digital channels (the Service). The Service is available to anyone who is or becomes a donor (the Donor or Donors), and to non-donors. As a Donor, you also get access to a certain amount of extra articles (the Bonus). Non-donors won’t be able to access the Bonus.
Donor / Donorship
You can become a Donor through the Website and get full access to both the Service and the Bonus. However, please be aware that the Donorship is a donation and not a payment for a service. I.e. FloorballToday will try their best to deliver the Bonus but this can’t be claimed by Donor and failure of delivering the Bonus is not a reason for reimbursement. It’s also worth noting that FloorballToday has the right to seize its activities without any prior notice; donations made – including donation which are technically still allow access to the Bonus – cannot be revoked.
You are responsible for managing your login details. If you lose your data or suspect that your account has been infringed, let us know immediately. FloorballToday has the right to refuse a request for Donorship.
Access code / Password
After becoming a Donor, you can log in with your chosen password. You can then make full use of the Bonus. Membership is intended for personal and non-commercial use. The Membership is strictly individual and we reserve the right to delete the the Donor’s account if account sharing is detected. It is therefore not permitted to provide your password to third parties. FloorballToday has the right to cancel a password after sending.
Payment
When you become a Donor, you will automatically receive a confirmation by e-mail (note your spam box). Payment must be made via the online payment service. When you apply for a Donorship, you will have the option to choose the amount you’re willing to pay, and the option to pay once or periodically. If you choose for a periodical payment, the amount is debited each month. If you pay once, the donation will be debited directly. If the payment term is exceeded, FloorballToday has the right to suspend Donorship, to dissolve it and to cease access to the Bonus.
Duration and termination
Donorship is entered into for an indefinite period of time. If you pay per month, you can cancel the Donorship at any time by sending an email to info@floorballtoday.com or cancel the Donorship directly in your account. The Donorship will then be terminated on the last day of that monthly period. A monthly period runs from the day that you became a donor until the same day the following month. If you pay a one-time amount, your access to the Bonus will be revoked after one year, starting from the day that you became a donor until the same day the next year. FloorballToday has the right to block or terminate your Donorship if it is suspected that you do not comply with this user agreement. Important:
Liability
FloorballToday is not liable for any damage that you may suffer as a result of using the Service and/or Bonus, unless that damage was caused by intent, gross negligence or deliberate recklessness on the part of FloorballToday. You acknowledge that FloorballToday is an authoring medium that (therefore) contains subjective information. Although FloorballToday makes every effort to provide correct and high-quality information, we do not guarantee that information via the Service and/or Bonus is correct. FloorballToday is not liable for the consequences of such (possible) inaccuracies.
Privacy
Privacy is important to the FloorballToday. We treat personal data in a confidential manner and in accordance with the Personal Data Protection Act (Wet Bescherming Persoonsgegevens). FloorballToday only processes the personal data provided by you to enable the use of the Donorship and to communicate with you in this regard. FloorballToday will not use the personal data for commercial purposes and will not provide it to third parties, unless (a) you have agreed, (b) this is necessary for the aforementioned purpose or (c) if FloorballToday is obliged to do so by law or case law. License
If you share content via the Service and/or Bonus (for example: in the contributions under an article), you give FloorballToday a perpetual, unconditional license to (further) make this content, or part thereof, public (in any way). reproduce, store or otherwise use for journalistic purposes.
Intellectual property rights
All content and layout (such as texts, photos, images, and other creations) of the Service are subject to intellectual and industrial property rights. It is not permitted without prior written permission from FloorballToday to publish, reproduce, scan or otherwise exploit (parts of) the Service and/or Bonus. Do you want to take over or purchase an item? Then contact us via the contact page.
Use
As a condition of using the Service, you agree not to provide information, data or content through FloorballToday that:
(a) promote racism, violence or hatred;
b) are false or misleading;
c) infringe intellectual property rights;
d) violate privacy rights;
e) violate any laws or regulations.
f) imitates or pretends kinship with a person or entity;
g) accesses non-public or secure areas of the Service;
h) sends viruses, worms, junk mail, spam, chain letters, unsolicited offers or advertisements of any kind and for any purpose;
i) examine, scan or test the vulnerability of the Service or other related system or network, or act in breach of any security or authentication.
FloorballToday reserves the right to remove your contributions or to deprive you of the reaction option if we find your responses do not meet the above guidelines or if you interfere with the journalistic process in any way.
Release of information
FloorballToday has the right to disclose information at any time (i) to defend itself in legal proceedings, (ii) to follow a court order, (iii) to comply with all laws, regulations or requests of the government, (iv) to protect national security, defense, public safety and public health and (v) to enforce the user agreement.
Complaints procedure
We do our very best to satisfy all our users. If you have a complaint, please let us know. Send your complaint as completely as possible via the contact page. Your complaint will be processed as quickly as possible, in any case within 30 days after receiving.
Disputes
Only Dutch law applies to this user agreement. Disputes will be submitted to the competent court in Amsterdam.
